Circuit Court #1

PRESIDING IN THE CLARK CIRCUIT COURT #1 ARE:

The Clark Circuit Courts each have original jurisdiction to preside over all civil and criminal cases. However, by Local Rule the Clark Circuit Court #1 has generally been assigned to preside over the following matters:

1) Murder, Class A, Class B, Class C, Level 1, Level 2, Level 3, Level 4, or Level 5 felony offenses as the most serious charged offense which are filed during the months of February, April, June, August, October, or December;

2) 50% of all Juvenile Paternity cases;

3) Mortgage Foreclosure, Civil Collection Cases, Small Claims and Mental Health Cases;

4) Guardianship cases involving adults, Estate cases (supervised and unsupervised), and Trust cases;

5) 50% of all Domestic Relations cases;

6) All cases involving Clark County Tax Sale or Conservancy District issues;

7) 25% of all Adoption cases;

8) Traffic infraction (IF) and ordinance violation (OV) cases;

Clark CIRCUIT Court #2

PRESIDING IN THE CLARK CIRCUIT COURT #2 ARE:

The Clark Circuit Courts each have original jurisdiction to preside over all civil and criminal cases. However, by Local Rule the Clark Circuit Court #2 has generally been assigned to preside over the following matters:

1) Class A, Class B, Class C, Class D Level 1, Level 2, Level 3, Level 4, Level 5, or Level 6 felony offenses which include a charge related to Controlled Substances under Indiana Code 35-48 or Legend Drugs under Indiana Code 16-42;

2) Civil Tort and Civil Plenary Cases;

3) All Civil Plenary cases;

4) All Protective Order cases, unless the Protective Order request is related to a Dissolution of Marriage case filed in another court;

5) 25% of all Adoption cases;

6) Reciprocal Support cases;

CIRCUIT COURT #3

PRESIDING IN THE CLARK CIRCUIT COURT #3 ARE:

The Clark Circuit Courts each have original jurisdiction to preside over all civil and criminal cases. However, by Local Rule the Clark Circuit Court #3 has generally been assigned to preside over the following matters:

1) All cases having a Class D Felony or Level 6 Felony as the most serious charge;

2) All Misdemeanor offenses except those occurring in the Town of Clarksville;

3) All misdemeanor and felony cases which include a charge relating to traffic or motor vehicles, under Title 9 of the Indiana Code or Indiana Code 35-42-1 (Homicide), with the exception of when a charge of Neglect of a Dependent is also filed. Cases where Neglect of a Dependent is also filed are filed in Circuit Court No. 4

 

4) 25% of all Adoption cases

5) All cases which include a Felony charge relating to traffic or motor vehicles, under Title 9 of the Indiana or under Indiana Code 35-42-1 (Homicide)

The Clark Circuit Courts each have original jurisdiction to preside over all civil and criminal cases. However, by Local Rule the Clark Circuit Court #4 has generally been assigned to preside over the following matters:

1) Murder, Class A, Class B, Class C, Level 1, Level 2, Level 3, Level 4, or Level 5 felony offenses as the most serious charged offense which are filed during the months of January, March, May, July, September, or November

2) All cases which involve a Misdemeanor or Felony charge against a defendant alleged to be under the age of eighteen (18) at the time of the commission of the offense

3) All cases which include a charge of Neglect of a Dependent or Contributing to the Delinquency under Indiana Code 35-46-1-8 or Violation of Compulsory School Attendance under Indiana Code 20-33-2

4) 50% of all Juvenile Paternity cases

5) All Juvenile CHINS cases, Juvenile Status cases, Juvenile Termination of Parental Rights cases, and Juvenile Miscellaneous cases

6) 50% of all Domestic Relations cases

7) 50% of all Guardianship cases

8) 25% of all Adoption cases

9) Guardianship cases involving children

10) When a family law case (e.g., dissolution, paternity, guardianship, adoption, reciprocal support) or a modification of an existing family law case involving the same family in the pending CHINS or juvenile delinquency matter is presented to the Clerk for filing, that matter shall be filed in or transferred to Circuit Court No. 4. When a CHINS or juvenile delinquency case is filed in Circuit Court No. 4 after a family law case has been filed in any other court, the judge with jurisdiction over the family law case shall transfer that case to Circuit Court No. 4. The Judge of Circuit Court No. 4 may request a transfer of certain criminal cases where those cases have a direct impact on allocation of parenting time or placement of the child in a pending CHINS or delinquency matter.

We're a court program that acts as guardian over the person only for those who have been ruled incapacitated and there is no one willing, capable, and suitable to do so.
